Rules Q&A
- Q: So I was thinking about this situation and I wanted to be sure I got things right.
Bayushi Hisoka targets a player and destroys a province granting that player a once per turn province refill face up until the end of the game. Said player has no Dynasty cards in his Dynasty deck, and is resolving an Event during his Event's Phase from Province 1. Opponent plays Subversive influence to prevent the event from resolving.
I believe the correct sequence from this point is this.
Subversive Influence shuffles the event into the Players Dynasty Deck. -->Event is Face down and out of play so: Subversive Influnce Effect stops affecting that card, instantaneous effect + tracking rule. Province 1 is Immediately refilled from Dynasty Deck, and per Hisoka's ongoing effect for the player, may be refilled face up, assuming it is. Sequence of Play now says go back to step B, which will again try to resolve the event.
Rules Say this...
Sequence of Play for Events F. a. If the province contains a different face-up card than the one dealt with in the previous steps B through E (for example, if the previous card was discarded and the province refilled face-up), return to step B and follow steps B through F for the new card.
While logically the Event is the same card. That card went Face down and out of play, so according to....
The Tracking Rule “Memory” of the status of individual cards ends when the card enters a deck or a hand, or otherwise becomes both face-down and out of play (such as after a card in the deck or hand is shown). This includes dishonorable status, ongoing effects, and whether or not an ability has been used.
EXCEPTION 3: If an effect does not distinguish between individual copies of a card, its “memory” remains even when the card is both face-down and out of play.
Clearly the Rule in F. a. is looking for the specific card (distinguishes the individual copy), thus the exception does not apply, and you start back at B. As is the Effect of Subversive Influence.
So the Event resolves again. Am I right?
A: Yes. Alex Jones, "Subversive Influence vs Bayushi Hisoka and Event Resolution", 28 Apr 2011 - Q: Comes from here: viewtopic.php?f=59&t=84339
Thanks for the answer, it is clear now that he can't buy the new card. But can he discard it?
http://rules.l5r.com/CE_Sequence_of_play#Dynasty_Phase: "Before the Dynasty Phase ends, a player may discard any face-up cards in his or her Provinces, one at a time. If an effect refills these cards face-up, he may discard their new cards. After the player discards any cards this way, he or she cannot bring further cards into play from Provinces that phase."
The bolded part makes me think he can, but I want to make sure of this. Thanks again!
A: Same section of the rules previously quoted: "Before the Dynasty Phase ends, a player may discard any face-up cards in his or her Provinces, one at a time." Emphasis added. Zen Faulkes, "Bayushi Hisoka XP refilling", 20 Jun 2010 - Q: A player has a province destroyed by Bayushi Hisoka XP reaction. Can he, at dynasty phase, discard a card, refill it face up, and buy or discard the new one?
A: http://rules.l5r.com/CE_Sequence_of_play#Dynasty_Phase: "After the player discards any cards this way, he or she cannot bring further cards into play from Provinces that phase."

Once you discard, you're done. Zen Faulkes, "Bayushi Hisoka XP refilling", 20 Jun 2010 - Q: in the same spirit, if I target Bayushi Hisoka XP "Political Reaction: Once per game, after Hisoka enters play, pay 4 Gold: Destroy a province belonging to a target player with 2 or more provinces. Until the game ends, once in each of his turns, he may refill one of his provinces face-up." with whispers of the dying sun when I have Emma O's Guidance "Open: Discard this card and destroy your target Personality: Bring into play a target dead Personality you own, reducing the amount of Gold you pay to put him into play by the first Personality's Gold Cost." in play, if I kill him and then use the guidance to bring him into play, can I pay the 4 gold 2ice to destroy 2 provinces, or would I have to find a way to kill him and bring him into play again in the same turn in order to be able to use his ability for the 2nd time?
A: You'd have to kill him and bring him back the same turn. Brook Cunningham, "multiple reactions to the same trigger by the same card", 5 May 2010 - Q: Regarding this ruling: http://www.alderac.com/forum/viewtopic.php?f=59&t=79042#p1047285, is the "...after Hisoka enters play" part of the constraints block(on his first ability) a condition that will be overridden, just like the "Once per game" part? If I target my Hisoka(who has already used his first ability when he entered play) with Whispers of a dying sun, can I pay the 4 gold to destroy a province?
Whispers of the Dying Sun Choose a (non-Stronghold) card in play. Each of its base abilities may be used one additional time this turn.
Bayushi Hisoka Scorpion Clan • Courtier • Imperial • Experienced • Loyal • Unique • Imperial Chancellor Political Reaction: Once per game, after Hisoka enters play, pay 4 Gold: Destroy a province belonging to a target player with 2 or more provinces. Until the game ends, once in each of his turns, he may refill one of his provinces face-up. Political Limited: A target player with 4 or more provinces loses 2 Honor.
A: If you can kill him and bring him back into play, yes, Whispers of the Dying Sun will allow Bayushi Hisoka xp to use his Reaction again in a game. (Extension of Border Keep ruling mentioned) Dan Jacobson, "Whispers of a dying sun + Bayushi Hisoka", 18 Jan 2010 - Q: Bayushi Hisoka Experienced reads: "Political Reaction: Once per game, after Hisoka enters play, pay 4 gold: Destroy a province belonging to a target player with two or more provinces. Until the game ends, once in each of his turns, he may refill one of his provinces face up."
The dispute is on when "after Hisoka enters play" occurs. I believe that the ability can only be paid once, when Hisoka enters play the first time. My opponent, playing the card, believes the ability may be used any time "after Hisoka enters play". Can I get some clarification on this wording?
A: The Reaction's constraints block has three parts: a usage limit of "Once per game", a trigger for the reaction of "after Hisoka enters play" and a cost, "pay 4 gold."
You may only take the reaction when the trigger occurs - ie "after Hisoka enters play" - but like all actions, it's optional. You don't have to take the reaction, you can wait until the next time he enters play, or the time after that, but you may only take the reaction once per game (wierder things have happened, especially in Open!), in total. Furthermore, if you wish to take the reaction, you must do so when the trigger occurs: you can't wait until later in the turn or until a subsequent turn.
